Now Govt. Have to soften stand # Section 377

After the landmark Supreme Court judgement in favour of LGBTQIA, it is the Govts. turn to reciprocate in toto

In the interests of one and all ...

My dear countrymen!

September 6, 2018, has been the golden dawn for the LGBTQIA**community. As to this day, the Apex court of India struck down section 377 and hence decriminalised the same-sex relationships in private. Criminals of yesterday are free people today. Though this draconian rule was 157 years old of British-era time was dropped years back in their own country but most, unfortunately, was still in force here.

L**- For Lesbians- When two Female adults make love and sex together are called lesbians. Only female comes under it.
G- For Gays-Making relationships between two consenting adults are known as Gays. Only Male members fall under it.
B - For Bisexual- One who enjoys both the sex is called as Bisexual. Male and Female both can be Bisexuals.
T- For Transgender/ Transexual- Physically Male but having more Female qualities, same way physically Female but having more Male qualities are called Transgender. Those who get sex changed through surgery also fall under these categories.
Q -For Queers, are different than LGBT. They have not decided whether they are Male or Female. They are also known as questioning.
I - For Intersex, By sex, they are neither Males nor Females are known as intersexual.
A - For Asexual- Are those who are interested in neither Male nor Female and vice versa.

The all five judges of Supreme Court bench not only unanimously restored all their (LGBTQIA) rights as equal citizens enjoying their lives with liberty, dignity and fraternity but also a recently inducted lady judge, Indu Malhotra went on to the extent that history, as well as entire country, must seek apologies to LGBTQIA communities for their long sufferings, harassments, tortures, discriminations, hardships and mental agonies for more than one and a half-century with no fault of their from any angle but only due to narrow societal thoughts and social stigmas attached with these communities.

This most anxiously and much-awaited landmark judgement of Supreme Court has disillusioned not only the entire gay community but whole world with awe and surprise. It has almost been proved that if one is determined and continues to fight for right causes till last without losing patience and heart, justice ought to come sooner or later.

Justice was already delivered to these deprived societies on 2nd July 2009 itself by a Delhi High Court bench of Chief Justice A. P. Shah and Justice S. Muralidhar which had ruled that consensual intercourse between two adults are not illegal. But 09 yrs later in the year 2013 Supreme Court overturning the order of DELHI high Court reinstated gay sex as a criminal offence. If some crusaders have not taken the tasks further to its logical conclusion even after the apex court’s unfavourable ruling, this happiest moments in the year 2018 would have been a distant dream for them.

Persons belonging to LGBTQIA communities are in every family, society, caste and religion, almost everywhere around the world including India since time immemorial. If we go back to our historical facts, anecdotes and mythological books .....etc. we will come across numerous strange, funny and unbelievably stories relating to the undeniable hard realities.

Badshah Allauddin Khilji was fond of clean-shaven good looking handsome Male for making love, pleasure and sex. It is said he had about 1000 gays in his harem.

There are many temples in India where we find proofs of their existence in plenty, prominent among those is Khajuraho temple specially Homoerotic Idols in MP ( India ) where we see the best craftsmanship and architectural marvels of various types of sexual activities among these communities where people/ tourists are denied access today. Our world fame great sex Guru Vatsayan, writer of the great book, “kama-sutra” has a separate chapter on these communities.

The world is changing at supersonic speed, and with the technological advancement every passing day nothing is unimaginable today and curiosity and capabilities have made everything within the reach of modern generations. So moving with the time is the order of the day otherwise we will always be lagging behind and perhaps never become a Super Power. our Apex Court judges have done their assigned role very laudably, gloriously, and in plain straightforward dignified manner.

Henceforth, people of India and the world too are looking forward towards Govt. of India to act as per the sentiments and spirits of the verdict. According to my opinion the government must without wasting time any further bring suitable legislation at its earliest keeping following in mind;
  1. First and the foremost job is to bring them into the mainstream as a normal citizen by applying all available means.
  2. Parents must be persuaded and encouraged to look after them without discrimination as other children at home or if possible offer parents some incentives so that they take up their responsibilities gladly without having any guilt.
  3. The whole country should be made aware and educated about them launching mass awareness programs by using all forms of media and by organising various cultural programs by celebrities, cine actors and actresses almost all parts of the country.
  4. Persons of these communities must be accorded all types of facilities and reservations in any field of their choice particularly in Education, Employment and Health Care in order that they could be brought in mainstream societies and also excel in their pursuits as responsible citizens.
  5. There should clear-cut guidelines from govt. to parents, families, people of all walks of life, all authorities Govts. as well as private companies, NGOs, police and others how to behave and treat them.
  6. Cracking jokes, making a mockery of them in public and instil fear in them of any nature strictly prohibited and be a punishable offence.
  7. They, LGBTQIA children should be treated with special care in schools, colleges and universities..... etc and thereafter there must not be any discrimination of any nature during their placement and employment.

If above measures are taken at the earliest which are nothing compared to their long sufferings and mental agonies they have gone through all these years for more than one and half centuries, we see no reason why their outlook is not changed dramatically in society and thus country will have a great sigh of relief and feel pride too in turning liabilities into great assets.

Jai Hind.
